The City Council will have a closed administrative session this evening to discuss the City Manager’s evaluation. Thank you to the many people who have talked with me in person, through email, and came to give public comments on tonight’s voting items.</p>\n<p>Best,</p>\n<p>Shana</p>\n<p>Please <strong>VOTE</strong>! City ballots were mailed Oct. 20. Most residents received their city ballots by Oct. 24 (City Clerk Carpenter can track them). It can take a week or more for the last few to be delivered. If a resident does not receive a city ballot in the next couple of days, call the city clerk at 301-891-7252. She can track whether it&#39;s been delivered and issue a new ballot package for the resident if needed. The intent is to ensure regular turnover of the lot. The system will consist of a mixture of spaces managed by Park Mobile and others with parking meters. The parking meters are intended to assist those that do not have or want the Park Mobile App.</p>\n<p>Details:</p>\n<ul>\n<li><p>Parking Fee: $1 per hour</p>\n</li>\n<li><p>Parking Limitations: 2-hour parking max time permitted</p>\n</li>\n<li><p>Hours: 7am-7pm; Monday - Saturday (free parking on Sundays)</p>\n</li>\n<li><p>No overnight parking allowed</p>\n</li>\n</ul>\n<p>Upcoming <strong>vegetation work in Belle Ziegler Park</strong>. A new hedgerow of mixed native shrubs will be planted this fall, and temporarily fenced off. The new hedgerow will grow to provide a similar benefit of screening the soccer field, but with the added value to neighboring trees and ecosystem.</p>\n<p><strong>Emergency pedestrian bridge repair</strong> is underway on Sligo Creek by Montgomery County Parks (NOT City of Takoma Park), near Maple Ave., begins. The work is expected to take approximately 6 weeks. As it is an emergency, the City did not receive advance notice.</p>\n<p><strong>Fri, Nov. 1- 9-11AM Peace Park Gardening</strong>—corner across from Maple Avenue bridge/Sligo Creek Parkway, one block from Essex House to do light gardening-easy weeding, clean-up and bulb planting. Resolution Directing Staff to Develop and Budget for a Multifamily Rehabilitation Tax Credit</p>\n<p><em>As I said last week, I will be voting in favor of these tax credits.</em></p>\n<p><em>Our community has expressed concern about providing a better quality of affordable housing for a long time. The preservation and affordable tax credits will help landlords, including many non-profits, to afford to reinvest and maintain the housing that they provide.</em></p>\n<p><em>As far as the New Rental Housing Tax Credit, we need to support the creation of new rental multi-family housing in Takoma Park. It has been impossible for developers to secure the financing they need from banks in order to build here. Forgone taxes will not be actualized if we don’t incentivize the building of new housing. There are opportunities throughout Takoma Park for infill or redevelopment, for example in the Takoma Langley Crossroads area, that developers have not utilized. We are working to make those types of projects realistic.</em></p>\n<p>6. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/agenda-item-20241030-building-improvement-grant-awards.pdf\">Single Reading Ordinance Approving Multifamily Building Improvement Grant Awards (PDF)</a></p>\n<p><em>This Grant Program is included in the ARPA budget. I will vote in favor of this ordinance.</em></p>\n<p><em>From the agenda item:</em></p>\n<p><em>“This program is funded through the American Rescue Plan Act (ARPA), as well as a NED Grant for the State of Maryland, and will not use General Fund Dollars. The newest vehicles we have in our marked fleet were purchased in 2021. We did, however, purchase vehicles in 2022 though we have not received them.</em></p>\n<p><em>I will vote in favor of this ordinance. The Chief of Police sees our deteriorating fleet as an impediment to our police department in doing their jobs. Monster Bash is a Halloween celebration that starts at Takoma Park Middle School on Piney Branch Road, then parades on Philadelphia Avenue to the 7500 block of Maple Avenue, where we have a community party with live music. Costumes are highly recommended.</p>\n<p>I attended the Mini-Food Forest Work Party at Takoma Park Elementary School along with Councilmember Honzak last Saturday. Our youngest children were also in attendance, but opted to play on the playground most of the time rather than to pull weeds with their moms. I know that the group was grateful for the work that Takoma Park’s Urban Forest Manager, Marty Frye, has done to support that location. I still strongly support these credits and hope that we can find some compromises in order to reach consensus. I am most willing to consider shortening the time span where developers will receive tax credits for New Rental Construction.</p>\n<h5>WORK SESSION</h5>\n<p>6. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/agenda-item-20241018-vehicle-purchase.pdf\">Procurement of 12 Police Patrol Vehicles (PDF)</a></p>\n<p>Our Police Department last purchased new patrol vehicles in 2021. The Council approved the purchase of three last year. These were supposed to be hybrid vehicles. The dealer continues to not have these vehicles and no concrete estimate of when they will have them. I don’t think any councilmember looks forward to purchasing city vehicles that are neither hybrid nor electric, even with the savings that we will see.</p>\n<p>I went to see three of these vehicles today at the Public Works yard. They are visibly quite worn. Age is only one of the metrics taken into account when deadlining a vehicle. Once a police patrol vehicle has 100,000 miles on it, the maintenance yard sees the costs to maintain that vehicle increase considerable. 100,000 miles on a patrol car does not fully capture the wear and tear on the engine. I hope some of you will be joining us.</p>\n<p>Best,</p>\n<p>Shana</p>\n<p>City Council Meeting Agenda - Wednesday, October 16, 2024</p>\n<p>Public Hearing on Tax Credits</p>\n<p>General Public Comments</p>\n<p>WORK SESSION</p>\n<p>2. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/Agenda-Item-20241016-food-insecurity-grants.pdf\">Food Insecurity Grant Recommendations (PDF)</a></p>\n<p>It is very impressive that our Grants Coordinator, Patti Mallin, and our Grants Review Committee work on such a diversity of projects. Since we have a high percentage of affordable housing, it is important to provide extra services to our residents that they need in order to thrive.</p>\n<p>3. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/agenda-item-20241016-housing-tax-credits.pdf\">Presentation on Fiscal Impact of Proposed Housing Tax Credits and Discussion of Proposed Housing Tax Credits (PDF)</a></p>\n<p><a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/fiscal-analysis-memorandum-2024-10-14.pdf\">New Rental Housing Tax Credit Fiscal Analysis (PDF)</a></p>\n<p>This type of fiscal analysis costs the City $29,500 and took about a month to complete. I understand that some residents were hoping to see an analysis of additional cost per resident, but to get the type of detail would be difficult on our limited budget.</p>\n<p>I have heard a wide range of views about whether now is the right time to proceed. The need for more housing has been an intensely discussed issue since the current council was elected in 2022. HCD Staff was working from the direction of this council’s priorities when they proposed these credits in July. The nation is experiencing a housing crisis. A major roadblock to economic growth in Maryland and in our city is the cost and insufficiency of housing. After the rezoning of Ward 6’s Takoma Langley Crossroads sector plan in 2012, there has been no new development of housing.</p>\n<p>Residential development supports other economic development in the City and throughout Maryland. We may forgo taxes for 15 years on those properties, but if our commercial properties are better supported with higher density population, we could increase our tax revenue with a higher commercial tax rate. These “tax credits” are targeted at providing denser multi-family housing in order to maximize the likelihood of that type of housing being built. The City also receives revenue from residents’ income as well, which we will not forgo.</p>\n<p>The City does not own the properties we are considering developing. They are privately owned. They will have to manage their own projects, not City Staff. Permitting is the County’s responsibility as are inspections.</p>\n<p><strong>Forgone Revenue and Expenses</strong></p>\n<ul>\n<li><p>The “tax credits” we are considering will only affect the taxes paid to the City.</p>\n</li>\n<li><p>Some of the City’s revenue comes from tax duplication from the County. If our population increases, so would the money from tax duplication.</p>\n<ul>\n<li>Most of our tax duplication is for Police and Public Works services</li>\n</ul>\n</li>\n<li><p>The Police Department also receives revenue from:</p>\n<ul>\n<li><p>Fines/ticketing</p>\n</li>\n<li><p>The State</p>\n</li>\n</ul>\n</li>\n<li><p>The Recreation Department charges for many of its services</p>\n</li>\n<li><p>The City does not provide waste management services for apartments over 12 units, which it is most likely all of the “tax credit” supported builds would be.</p>\n<ul>\n<li>In addition, multi-family buildings are responsible for snow removal, sidewalk infrastructure, and the vegetation management on their properties, even within common areas.</li>\n</ul>\n</li>\n<li><p>Most of our City Staff numbers wouldn’t need to be increased, as the footprint of the City would stay the same:</p>\n<ul>\n<li>For example: vegetation management, urban forest management, city engineer, senior level staff</li>\n</ul>\n</li>\n</ul>\n<p><strong>Infrastructure Capacity</strong></p>\n<ul>\n<li><p>During the Site Plan Review Process, Montgomery County would consider the plan to decide if any increase of infrastructure was necessary to support additional homes. Development doesn&#39;t always take resources from a city.</p>\n<ul>\n<li><p>Montgomery Planning would at this time consider schools, waste management, transportation issues, traffic loads</p>\n<ul>\n<li>We have not had any added meaningful capacity to our elementary schools–added development could benefit us if more students were added and a new school was finally built.</li>\n</ul>\n</li>\n<li><p>This is also the point in the planning process at which a developer may choose to or be directed to provide other public benefits such as:</p>\n<ul>\n<li>Green space, traffic infrastructure improvements, pedestrian infrastructure improvements</li>\n</ul>\n</li>\n</ul>\n</li>\n</ul>\n<p><strong>Stormwater &amp; Tree Protectio</strong></p>\n<ul>\n<li><p>Stormwater fees are not included in the “tax credit,” properties must still pay their entire stormwater fee.</p>\n<ul>\n<li><p>construction will have to meet stormwater management requirements for the site will require treatment</p>\n<ul>\n<li><p>50% of the run-off from the existing impervious area</p>\n</li>\n<li><p>treatment of 100% of run-off from the new impervious area</p>\n</li>\n</ul>\n</li>\n</ul>\n</li>\n<li><p>Our City’s Tree ordinances are still in place.</p>\n</li>\n</ul>\n<p><strong>Other thoughts on this report</strong></p>\n<ul>\n<li><p>The maximalist numbers are included in order to show maximum amount of forgone tax revenue</p>\n</li>\n<li><p>assumes that without policy change, there will be zero development at the WAH site.</p>\n<ul>\n<li><p>This is what we have seen since the Takoma Langley Crossroads Plan.     "content_html": "<div><p>Good Evening,</p>\n<p>There is no City Council meeting this week, but I do have a couple of things to share.</p>\n<p><strong>There has been an increase in crime in Ward 1:</strong></p>\n<ul>\n<li><p>There have been several commercial burglaries in businesses in Ward 1 and Ward 3 over the last month. The Takoma Park Police Department had one meeting with business owners and OTBA Executive Director Laura Barclay. The Police Department provided some information and suggestions for those business owners. I have heard that business owners were generally pleased with the meeting. Since the meeting there have been more burglaries. The TPPD is planning to work with businesses to get them tracking devices for their register drawers. They will also be moving a police camera to the area and have already started more high visibility patrols. The Mayor and I will join the TPPD and business owners for a second meeting in the near future.</p>\n</li>\n<li><p>There has also been an increase in thefts from automobiles. Please remember to remove all your valuables from your car and to lock it.</p>\n</li>\n</ul>\n<p><strong>Last week’s meetings:</strong></p>\n<p><strong>Housing Strategic Planning Discussion 9/24:</strong> HCD presented three plans to help support low and moderate residents in Takoma Park. Four proposals were originally being considered. Staff has recommended that we consider only the three right now. This is because one program focused on missing middle housing construction and there are a few similar supports proposed from the state and federal level.</p>\n<p>Important points to highlight:</p>\n<ul>\n<li><p>The City currently provides Payment in Lieu of Taxes (PILOT/tax credits) to seven buildings in Takoma Park. These PILOTs are reducing their taxes by 50% and all will expire by the FY2027.</p>\n<ul>\n<li>Takoma Park has historically done PILOTS that last ten years. Montgomery County presently does them in perpetuity.</li>\n</ul>\n</li>\n<li><p>The proposed credits are suggested in place of the previous PILOTs the City once offered.</p>\n<ul>\n<li>The City’s PILOTs did not have a true “system” in place. Building owners or developers would informally ask for them mostly through councilmembers. It was an inequitable process since it required being savvy enough to know to ask.</li>\n</ul>\n</li>\n<li><p>Tax credits for the New Rental Construction will only apply to added units. This proposal would not reduce the current tax load of a landlord, but would forgo possible tax revenue for the City for a limited period of time.</p>\n<ul>\n<li>In future years, these units would add revenue to the City.</li>\n</ul>\n</li>\n<li><p>In order to take part in the Affordable Housing Preservation Credit, a deed restriction must be in place and the credit would be reviewed annually.</p>\n</li>\n<li><p>City Staffing costs have been brought up in this discussion. It is not as simple as a mathematical formula to determine what each additional resident will mean in staffing. For example, we wouldn’t need an additional City Manager or department directors. Apartment buildings with more than twelve units are required to provide their own trash removal. Recreation is in large part covered by fees.</p>\n<ul>\n<li>An outside consultant is currently working on a full fiscal analysis expected to be available mid-October.</li>\n</ul>\n</li>\n<li><p>If the City Council votes in favor of an ordinance for the proposed credits, the City would have a public comment period while HCD Staff continues to work on how to implement the program. After passing, Council may also request another public forum to get input. Council may also request an annual review of the programs to determine when we reach a point where we should suspend them.</p>\n</li>\n<li><p>Tax credits are an important part of a project’s portfolio when a developer or landlord secures financing. A small amount of tax revenue forgone for the City can mean millions of dollars of money invested in our residents, both current and future, by banks, non-profits, the state, and the federal government.</p>\n</li>\n</ul>\n<p><strong>City Council 9/25:</strong> Restricted covenants were a large part of Wednesday’s discussion. I went in thinking I supported one plan, moving somewhat quickly, and came out supporting another plan, seeking state level legislation changes. The wording of the Maryland law makes it onerous for the City to remove restricted covenants. We are hoping to have some language changes in the law, without having to pass new legislation. This would make it easier for all Maryland cities to remove restricted covenants, making a bigger impact for all of Maryland while costing the City less money. I spoke with Jim Douglas from Historic Takoma and he is also in support of pursuing the legislative change.</p></div>"

This meeting was to look at the proposal for new sidewalks along Hodges Lane, Darwin Avenue, and Chestnut Lane. These would not only serve those residents along those streets but also better connect everyone to Takoma Park Elementary School, Takoma Park Middle School, and the Takoma-Piney Branch Park. The proposal is not yet finalized as there is still discussion to have about specifics with the neighbors on those streets. I expect that construction will take place in FY2026, so after next June.</p>\n<p>On Saturday, I attended the Long Branch Festival. I really appreciate how businesses and organizations all throughout Takoma Park show up to celebrate together. On Sunday I was lucky enough to get to taste 17 different apple pies and 6 others as a judge for the Takoma Park Farmers Market Pie Contest. According to OTBA’s Laura Barclay, “The market raised a record $1,761 which will entirely be used to extend the shopping dollars for those using federal benefits at the market!” Thank you to all of our bakers and to everyone who bought a pie ticket to take a taste of our entries.</p>\n<p>This Thursday at 2pm I will attend the ribbon cutting ceremony for the <a href=\"https://mocoshow.com/2024/08/09/montgomery-college-announces-opening-of-the-catherine-and-isiah-leggett-math-and-science-building/\">Catherine and Isiah Leggett Math and Science Building at Montgomery College</a>. I went to the ice cream social they held last week and the new building is gorgeous. The science classrooms looked particularly inviting.</p>\n<p>This Saturday September 21st from 10-2 I will attend the <a href=\"https://letsplayamerica.org/\">16th Annual Play Day</a>. Director Braithwaite has worked with them and proposes to add stop signs at Westmoreland and First Avenue. This added compromise assuages some opposition. I have a hard time wrapping my head around people speeding on this busy road. Thank you everyone who came out to take part and to watch, especially State Senator Will Smith. A special thank you to Birchie Seiffert and Jeremy Heikus for taking time away from your families to come out to nominate me.</p>\n<p>I hope everyone enjoyed watching the presidential debate last night. I watched it at Busboys and Poets, which was filled with laughter and audible gasps. I highly recommend for the next debate, that is if VP Harris is able to convince Trump to take her up on the offer.</p>\n<p>I’ll attend the Takoma Park Pie contest as a judge this Sunday. I, self indulgently, encourage you to <a href=\"https://shanafulcher.us22.list-manage.com/track/click?u=9460cbc5a711175786dd77a95&id=73716d614e&e=6aabebd32b\">enter</a>.</p>\n<p><strong>Laurel Avenue Closure</strong></p>\n<p>In June, we had a presentation on the Laurel Avenue Traffic Study. The study showed that the most significant impact a closure to the southbound lane of Laurel Avenue would be on the intersection of Eastern Ave/Willow St./Carroll Ave. It makes the recommendation that a roundabout be installed. That intersection is already experiencing failure at times without the closure of southbound Laurel Ave. I think we should start engaging with DC on addressing that intersection; however, DC is experiencing higher levels of pedestrian fatalities now than when it started keeping that metric, so they have other priorities over this traffic issue.</p>\n<p>When talking to residents I have heard more in favor of closing southbound Laurel Ave than those against, however, I have heard many of those against the closure ask, “could we close it on the weekends?” as a compromise. One of the arguments against this compromise is that the plan to close both sides of Laurel Avenue would be to create a true public space that has been hardscaped and landscaped for public enjoyment. This is not just a project to support the businesses but to support the community. While I would prefer a more permanent space with a more enjoyable atmosphere than a temporary space would allow, I am confident that the number of people who support the closure will increase after enjoying the weekend space. Here is a description that I received today of the work being done.Stormwater Work is Scheduled: 9/5/2024</p>\n<p>The City plans to install stormwater improvements on Birch Avenue, near</p>\n<p>the intersections of Cedar Avenue and Barclay Avenue. The work hours will</p>\n<p>be 7 am to 5 pm. Access to parking will be limited or blocked during the</p>\n<p>work. Rain or inclement weather can delay the schedule. The work is</p>\n<p>expected to last a week or two.</p>\n<p>During the work, traffic will be redirected as needed and one lane of traffic</p>\n<p>will be maintained with a flagging operation.     "content_html": "<div><p>I continue to support the Takoma Park Minor Master Plan Amendment. The Takoma Park MMPA’s zoning changes provide an opportunity for the City to have more rental units, both affordable and under the jurisdiction of our rent stabilization ordinance, and create more homeownership opportunities</p>\n<p>I have previously written on this topic on <a href=\"https://www.shanafulcher.com/post/the-takoma-park-minor-master-plan-amendment\">August 1st, 2023</a>.</p>\n<p><strong>Consideration of the County Executive’s Racial Equity and Social Justice Review</strong></p>\n<p>The analysis on the Takoma Park Minor Master Plan Amendment, commissioned by County Executive Marc Elrich, is found here, <a href=\"https://documents.takomaparkmd.gov/government/housing-and-community-development/community-development/Minor_Master_Plan/2024.03.18-Elrich-Transmittal-Comments-on-TPMMA-w-Equity-Analysis.pdf\">pages 43-50.</a></p>\n<p>The three conclusions drawn by this memo are:</p>\n<ol>\n<li><p>There is an “<em>arbitrary plan boundary</em>”</p>\n</li>\n<li><p>There were “<em>community engagement gaps</em>”</p>\n</li>\n<li><p>The Plan’s use of “<em>weak language</em>”</p>\n</li>\n</ol>\n<p>Some people have claimed that the Takoma Park City Council and Montgomery Council did not properly review this information; I disagree with that assertion.</p>\n<ol>\n<li>The Takoma Park MMPA boundary was set by the sitting City Council on July 7, 2021, by a unanimous vote, which was then Mayor Stewart, Councilmember Kovar, Councilmember Dyballa, Councilmember Kostiuk, Councilmember Seamens, Councilmember Smith, and Councilmember Searcy. <a href=\"https://documents.takomaparkmd.gov/government/city-council/resolutions/2021/resolution-2021-22.pdf\">Resolution 2021-22</a></li>\n</ol>\n<p>The City Council members at the time saw the amendment plan as an opportunity to update an aging 2000 Takoma Park Master Plan. The areas that were included in the Takoma Park MMPA were advocated for by the councilmembers representing those wards.</p>\n<ol>\n<li>An extensive effort was made in order to engage with Takoma Park residents throughout and adjacent to the MMPA boundaries, as is detailed here in the Takoma Park MMPA <a href=\"https://montgomeryplanning.org/wp-content/uploads/2023/06/TPMMA-Appendix-A-Community-Engagement-and-Outreach.pdf\">Appendix A</a>.</li>\n</ol>\n<p>From the Montgomery County Planning section on Equity in the Planning Process:</p>\n<ul>\n<li><p>Multilingual canvassing at multifamily properties along Maple and Lee avenues (239 in-person interviews) and Washington Adventist University (85 interviews).</p>\n</li>\n<li><p>Translation of engagement materials in Spanish, French and Amharic</p>\n</li>\n<li><p>Outreach at farmers’ markets and “pop-up” efforts at neighborhood retail centers.</p>\n</li>\n<li><p>Meetings with civic and homeowners’ associations, community, and neighborhood organizations.</p>\n</li>\n<li><p>Regular communication with City of Takoma Park staff and City Council</p>\n</li>\n<li><p>An online questionnaire.</p>\n</li>\n<li><p>Posting signage throughout the plan area.</p>\n</li>\n<li><p>Participating in community events, including National Night Out and Bike to Work Day.</p>\n</li>\n<li><p>Hosting a community Open House in October 2022 (100+ attendees).</p>\n</li>\n</ul>\n<p>As stated in Mayor Searcy’s letter to the Montgomery County Council:</p>\n<p>“The City and M-NCPPC staff then worked collaboratively to bring a robust engagement to residents in the community. This engagement included door-to-door surveying, table sitting at numerous community events on Maple Avenue, monthly newsletter articles and other mailers, and community presentations and meetings hosted by City staff, M-NCPPC, or City Councilmembers.”</p>\n<p>I personally walked throughout Ward 5 with our Summer RISE students to put flyers on doors and at Essex House to advertise the meeting that Councilmember Honzak held on July 18th, 2023.</p>\n<ol>\n<li>The Takoma Park Minor Master Plan is more forceful with its definition of “no net loss of affordable housing” than we have seen in other plans approved by the County Council.</li>\n</ol>\n<p>“No net loss of affordable housing requires that all affordable housing units (both naturally occurring and income-restricted units) lost through demolition be replaced or rebuilt.”</p>\n<p>County Executive Elrich pointed out in his memo:</p>\n<p>“Councilmember Jawando stated he understood that unless projects for individual large apartment buildings included no-net-loss, the project would not be approved, and Planning Board Chair Artie Harris agreed with this statement at the session.”</p>\n<p>He further stated that this is not explicitly stated in the Takoma Park MMPA, however this is part of the public record and the understanding of both the Montgomery County Council and the Takoma Park City Council, both of which will hold them accountable during the development process.</p>\n<p>There are parts of the Equity Analysis memo that seem to refer to the <em>County’s Thrive 2050</em> General Plan or other County policies, such as a reference to “directly stating that the biggest issue is ‘concentrations of poverty,’” which is not stated in the Takoma Park MMPA. Our City Council strives to create policies that will support inclusivity throughout all parts of the city. Racial equity calls for diversifying types of residential; by diversifying housing stock throughout the City, income levels will also diversify throughout the City.</p>\n<p>The City Council recognizes that creating the type of development that we as a city envision is not an easy task, but it is one that will be done through good policies, from our city, county and state, not in a zoning plan.</p>\n<p><strong>Our Mayor’s Authority</strong></p>\n<p>From the <a href=\"https://mgaleg.maryland.gov/Pubs/LegisLegal/Muni-Charters/2022-municipal-charter-takoma_park.pdf\">Charter of Takoma Park</a>, section 303 (a): “the Mayor shall be recognized as head of the City government for all intergovernmental affairs”</p>\n<p>Most of the conditions the City council requested in Takoma Park City Council Resolution <a href=\"https://documents.takomaparkmd.gov/government/city-council/resolutions/2023/Resolution-2023-38.pdf\">2023:38</a> (voted 6-1 on December 13, 2023 as referenced in the Mayor’s <a href=\"https://documents.takomaparkmd.gov/government/housing-and-community-development/community-development/Minor_Master_Plan/2024_03_25_MMPA_Mayor-Letter-to-County-Council-final.pdf\">letter</a>) were adopted by the Planning Board during their Work Session Number 6 on December 14, 2023. One item they did reject, recommending that Takoma Park change its rent stabilization policy, was then removed by the County Council during its session on the MMPA. The Montgomery County Council also increased the MPDU requirement for the MMPA from 12.5% to 15%.</p>\n<p>After these changes were made in accordance with Takoma Park City Council’s <a href=\"https://documents.takomaparkmd.gov/government/city-council/resolutions/2023/Resolution-2023-38.pdf\">Resolution</a> supporting the MMPA and after all councilmembers reviewed the memos from the County Executive, it was reasonable that Mayor Searcy would only check in with members of the City Council to see if their votes had changed and convening was necessary. There was no secret closed meeting.</p>\n<p>The Mayor is effective in working with our County Council. When she requested they delay a vote on the Takoma Park MMPA until receiving the County Executive’s memo, they obliged her request and didn’t require a formal resolution from the City in order to do so.</p>\n<p>Under the Mayor’s leadership, the City Staff has been considering equity considerations highlighted in the County Executive’s memo as issues to be addressed by policies, not through the zoning.</p>\n<p><strong>Displacement Concerns</strong></p>\n<p>Many of our rental properties on Maple Avenue are protected by covenants/easements for years to come. There is not a pathway for the landlords/property owners to opt out of these covenants before their expiration date. Due to the rent stabilization in Takoma Park, rental property prices have held a lower market rate making them more affordable to nonprofits, who have taken advantage of that lower price and now own properties within the MMPA.</p>\n<p>In the Takoma Park MMPA that residents will have the right to move back into buildings after renovations/rebuilds. The City Council passed Ordinance 2023-17 in 2023 regarding tenants rights due to displacement from their residences being condemned. In the past, when renters have experienced displacement, City Staff have often been involved in the process of finding tenants comparable housing until their homes were once again available. It is possible that the City would be a partner in finding temporary housing while apartments are under construction. Our Housing and Community Development Department is trying to find ways to encourage development within our rent stabilization confines. One proposal they have brought before council is for a “New Multifamily Housing Tax Credit” which would only apply to added units.</p>\n<p>The MMPA is written to encourage infill on properties, not to instigate tearing down buildings. The most likely outcome will be the addition of more rental units. These units will exist within a rent stabilization market that many other units already exist in. The “Market Rate” for these new units, which will be neighboring deeply affordable housing (Takoma Park’s median rent is about ⅔ of Montgomery County’s rent), is unlikely to be able to set a significantly higher rent comparatively.</p>\n<p>Takoma Park has seen rental units disappear from the market over the last thirty years. This isn’t because landlords “don’t need the money,” but because the costs incurred by landlords outweigh the profits they are making. Many of the single family homes throughout Ward 1 were once split into multiple units but are now being used by one household. As land values increase and people choose to age in place, we can expect homeowners to continue to build larger houses that reflect the increasing value of the land they sit on.</p>\n<p><strong>Environmental Considerations</strong></p>\n<p>The Takoma Park MMPA has two different sections that cover environmental considerations. <a href=\"https://montgomeryplanning.org/wp-content/uploads/2023/06/TPMMA-Appendix-D-Environment.pdf\">Appendix D</a> is a broad look at the environmental requirements for development within the zoning area while <a href=\"https://montgomeryplanning.org/wp-content/uploads/2024/01/Takoma-Park-Climate-Assessment-FINAL-1-18-24-Transmitted.pdf\">Climate Assessment</a> “evaluates the anticipated impacts” ”on the county’s GHG emissions and reductions.” Due to the large amount of impermeable concrete and asphalt surfaces, there is a lot of room for improvement with regards to stormwater management. Takoma Park’s stricter tree ordinances and stormwater management practices will be required of any development. It specifically states the goal “an overall 60% tree canopy cover within the plan area.”</p>\n<p><strong>Developers are Leading the Charge</strong></p>\n<p>The City is not currently working with a developer on a plan for the Maple Avenue Corridor of the Takoma MMPA. It is not from a desire to appease developers that the City Council seeks to build new housing and rehabilitate older housing, but from a housing shortage experienced all throughout the DC metro area and from the right of residents to live with dignity in all of Takoma Park. While upzoning may increase the property values, the City Council and Staff are concerned about the rising property values and the threat of displacement without a zoning change. We have left flexibility in the Takoma Park MMPA not only to entice developers, but to create more possibilities for us to meet the needs of our residents during negotiations in the development process. We need the diversity of affordable rental housing and opportunities for middle income families to own their homes. We need flexibility to attract new employment opportunities with the loss of the hospital.</p>\n<p><strong>Development will Disregard School Capacity</strong></p>\n<p>School capacity is one of the limiting factors of development. There have been school capacity issues within MCPS that have placed moratoria on building. Our City Council continues to talk about how to get Piney Branch Elementary School its needed renovation. I support the recent changes to Administrative Regulation for Traffic Calming and Sidewalk installation to make it easier for residents in high density areas to engage in the traffic calming process. These changes also call for proposed installations be evaluated for how they connect our community to schools, public parks, and public transportation. When choosing which MWCOG boards to sit on, I specifically sought to be on the Transportation Planning Board because I believe it best positions me to understand bigger regional issues in achieving our local goals.</p>\n<ul>\n<li><strong>Advancing homeownership opportunities for middle income residents.</strong></li>\n</ul>\n<p>Takoma Park has an obligation to diversify housing stock, both through building new homes and supporting changes in single family housing zoning. Homeownership is one of the best ways that we achieve generational wealth and opportunities for homeownership need to be expanded. I supported the Minor Master Plan Amendment as a zoning tool to remove a barrier in the creation of more housing. I recently attended the MML’s Summer Housing Symposium to better understand State resources available to Takoma Park.</p>\n<ul>\n<li><strong>Addressing the City’s structural deficit.</strong></li>\n</ul>\n<p>Over the past year I took part in a Finance &amp; Budget Working Group along with two other council members to examine some possible solutions. We did not find simple answers. The deficit that we have will have to be addressed by the City Manager’s Office and City Council working together to make big changes in our spending and revenue. The working group expanded the budgetary calendar in order to make bigger changes more feasible and to allow time for more public feedback. When I took part in the hiring of the new City Manager, we made it clear that addressing the City’s deficit is a priority for the City Council. I have recently joined the board of the Montgomery County chapter of the Maryland Municipal League in order to continue to advance the tax duplication issues that we experience and to push our County Executive’s Office of Management and Budget to correctly account services our municipality provides.</p></div>"

The estimate provided by the construction company was based on measurements the City provided. When the work began it was obvious that more work than was originally expected by Public Works staff. The study showed that the way traffic would naturally reroute itself would be most impactful during the mornings, which seems somewhat obvious because it is a southbound lane. This traffic study was inclusive of projected numbers with the incoming development on the DC side of Takoma. The most affected area is an intersection that we share with DC, at Willow Street, Easter Avenue, and Carroll Avenue/Street. Already, that intersection has an above acceptable Level Of Service. I am starting to reach out to DC elected officials to discuss the recommendation of this study for a traffic circle at that intersection, which would benefit the use of that failing intersection for all residents of Takoma Park, MD and Takoma DC. . The 2025 budget does not include money for any work on a Laurel Avenue closure and that project is not a current priority for the City Council.</p>\n<p>Voting Session</p>\n<p>2. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/agenda-item-20240612-2nd-Rdg-Budget-Amendment.pdf\">Second Reading Ordinance Approving FY 2024 Budget Amendment No. 4 (PDF)</a></p>\n<p>From last week:The budget deficits in this amendment are to account for monies planned for from red light cameras and speed cameras. The SHA was very slow to grant our red light camera installation requests (which they have recently granted). The City’s speed cameras have been extremely effective causing there to be less revenue than planned.</p>\n<p>3. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/agenda-item-20240612-vehicle-purchase.pdf\">Single Reading Ordinance Approving Procurement of Three Police Vehicles (PDF)</a></p>\n<p>The TPPD seeks to purchase three vehicles that are included in the FY2024 Budget. After reviewing the Equipment Replacement Reserve, along with Councilmembers Gibson &amp; Seamens, I have seen that we are following best practices on vehicle replacement. I support the purchase of this hybrid vehicle.</p>\n<p>4. <a href=\"https://dwpl4lfcfux0y.cloudfront.net/government/city-council/agendas/2024/agenda-item-20240612-NED-Grant-Submissions.pdf\">Resolution Authorizing Submittal of NED Grant Applications (PDF)</a></p>\n<p>This resolution authorizes our HCD Department to apply for grants to support low and moderate income homeownership through a Home Maintenance Assistance Program, a First Time Homebuyer Revolving Loan Fund, and the development of a low-income Senior Housing Apartment. Supporting new homeownership and the stability of homeownership for low and moderate income residents is a personal and Council priority. Our HCD Department is outstanding at knowing what grants we will be successful in with that support our City’s priorities.</p>\n<p>5. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/agenda-item-20240612-Deauville-purchase.pdf\">Single Reading Ordinance Authorizing the Use of NED Grant Funds to Assist with the Tenant purchase of 7520 Maple Avenue (PDF)</a></p>\n<p>Similar to the grant we are seeking above, this is to allow the disbursement of funds the City acquired to support low &amp; moderate homeownership. The recommended amendments are to adjust for:</p>\n<p>1. USPS issues. If we allow ballots to be received until the fifth business day, it delays tablature and cuts it very close on swearing in of elected officials. Also, many ballots show proof of being mailed within the appropriate time frame, other than the meter stamp. This change would allow those ballots to count.</p>\n<p>2. It seems appropriate to allow candidates to use loans in their campaigns. I attended the Montgomery County Older Girl Scout’s end of the year recognition where I was joined by Montgomery County Councilmember Laurie-Anne Sayles and Maryland State Delegate Sarah Wolek. I was touched that these wonderful female leaders attended our meaningful ceremony for teen Girl Scouts who have completed their Silver, Silver Trefoil, &amp; Gold Awards. I was honored to have been the keynote speaker.</p>\n<p>Two dates I hope you will join me for:</p>\n<p><em>Takoma Park Police Department Ward One Community Meeting-June 11th from 7pm-9pm Azalea Room, Takoma Park Community Center on Maple Avenue</em></p>\n<p>I have requested a meeting with Chief DeVaul and TPPD to discuss any concerns Ward 1 residents have about our community’s safety and police. I requested this meeting not due to any particular incident or trend in Ward 1 or Takoma Park. We continue to experience lower levels of crime compared to areas around us. I, along with other City Councilmembers, have been pleased with the budget and the process this year. It felt like there was a little less to discuss this year as there was less money to spend since our ARPA dollars are dwindling. I expect the upcoming year to have conversations before we get into budget season and to see bigger budget changes as our new City Manager learns more about how our city works on a more intimate level. We have included in this budget money to work with a consultant on performance measures.</p>\n<p>4. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/agenda-item-2024-04-15-CityTV-Support.pdf\">Single Reading Ordinance Authorizing the City Manager to Sign a Contract with Human Circuit for Technical Services for City TV (PDF)</a></p>\n<p>As the City TV will be moving to a different location during renovations, they will need to move their equipment, which has never been cataloged. Some equipment is no longer in use and will be removed. This job will need to be done quickly so that there isn’t an interruption in services.</p>\n<p>5. <a href=\"https://documents.takomaparkmd.gov/government/city-council/agendas/2024/agenda-item-2024-04-15-HRIS-System.pdf\">Single Reading Ordinance Authorizing the City Manager to Enter into a Contract with UKG for Implementation of a Human Resources Information System (PDF)</a></p>\n<p>Our current HR software is outdated. I appreciate this run down and look forward to also hearing from staff what the implications are for our city and what the City Council needs to do in order to take advantage of some of the new legislation.
